Terms of Service
Effective date: October 2, 2026
GoGrocery operates at gogrocery.ca (Calgary, Alberta, Canada). Questions: support@gogrocery.ca.
1. Agreement
These Terms of Service ("Terms") govern your access to and use of the GoGrocery website and services at gogrocery.ca (the "Service"), operated by GoGrocery ("we," "us," or "our"). By creating an account, placing an order, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Service description
GoGrocery offers online browsing and ordering of grocery and related products with local delivery in the Calgary, Alberta area (including pilot or waitlist areas as described on the site). Product availability, pricing, and delivery coverage may change without notice. All prices are shown in Canadian dollars (CAD) unless stated otherwise.
3. Accounts
You must provide accurate information when registering. You are responsible for activity under your account and for keeping your credentials secure. You may register with email and password or use Google Sign-In where available; Google authentication is subject to Google's terms and privacy policy as well as these Terms.
You must be at least the age of majority in Alberta to create an account and place orders, or use the Service only with involvement of a parent or guardian where permitted by law.
4. Orders and payment
Placing an order constitutes an offer to purchase. We may accept or cancel orders (for example, due to stock unavailability, pricing errors, delivery limits, or suspected fraud). Order confirmation emails describe next steps.
Payment is by Interac e-Transfer to the address and instructions shown at checkout (typically payments@gogrocery.ca). You must send the exact order total and include your order reference as instructed. We schedule fulfillment after payment is received and confirmed. We do not process credit or debit cards directly through the website unless we explicitly add that option later.
5. Delivery
Delivery times and areas are estimates and may vary. You agree to provide a valid delivery address and reasonable access for delivery within our service area. Risk of loss for products passes to you upon delivery to the address you provided, subject to applicable consumer protection law.
If you are outside our current delivery zone, you may submit a waitlist request where offered; no payment is required until we confirm we can serve your area.
6. Product information
We strive to display accurate product names, images, sizes, and prices. Retail sourcing and promotions change; substituted items, weight variations, or out-of-stock cancellations may occur. We will contact you when practical if a material change affects your order.
7. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of these Terms;
- Attempt to gain unauthorized access to accounts, systems, or data;
- Scrape, overload, or interfere with the operation of the website;
- Provide false or misleading order or account information.
8. Intellectual property
The GoGrocery name, logo, website design, and content we provide are owned by us or our licensors. You may use the Service for personal, non-commercial shopping only. Product images and trademarks belong to their respective owners.
9. Disclaimer of warranties
The Service is provided "as is" and "as available" to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement except where such disclaimers are not allowed under Alberta or Canadian consumer protection law.
10. Limitation of liability
To the maximum extent permitted by law, GoGrocery and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service or an order will not exceed the amount you paid to us for that order in the twelve (12) months before the claim, except where liability cannot be limited by law (including certain consumer rights in Alberta).
11. Indemnity
You agree to indemnify and hold harmless GoGrocery from claims arising from your misuse of the Service or violation of these Terms, except to the extent caused by our negligence or willful misconduct.
12. Changes
We may modify these Terms or the Service at any time. We will post updated Terms on this page with a new effective date. Material changes may also be communicated by email or notice on the site. Continued use after the effective date constitutes acceptance where permitted by law.
13. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Disputes will be brought in the courts of Alberta, except where consumer protection law requires another forum.
